Terms of Service

1. Agreement
These Terms of Service ("Terms") are a legally binding agreement between you ("User") and ZanKo, LLC, a Louisiana limited liability company ("Company"), governing your access to and use of the SnapTheChange platform ("Service").
By accessing or using the Service, you agree to be bound by these Terms.
2. Nature of Service
SnapTheChange is a digital documentation and workflow platform designed to assist contractors in capturing and organizing project-related information.
The Service does not provide legal advice, guarantee payment, enforce contracts, act as escrow, verify licensing, or validate pricing, scope, or workmanship. Users are solely responsible for their business decisions, contractual agreements, compliance obligations, and work performed.
3. Electronic Communications & Signatures
By using the Service, you consent to receive communications electronically and agree that electronic records and signatures may be used in connection with documentation created through the platform.
You are responsible for determining the legal sufficiency and enforceability of any electronic document.
4. AI-Generated Content
The Service may generate draft language using artificial intelligence. AI output may contain errors or omissions and may not reflect applicable laws.
Users are solely responsible for reviewing and approving all generated content prior to use. The Company disclaims liability arising from reliance on AI-generated content.
5. User Responsibilities
You are solely responsible for:
- All uploaded content and pricing
- SMS communications and recipient consent
- Compliance with federal, state, and local laws
- Project execution and client relationships
The Company does not supervise or validate user activity.
6. SMS & Communications
If you use SMS features, you represent that you have obtained proper consent from recipients and will comply with all applicable telecommunications laws, including TCPA requirements.
Message frequency may vary. Standard carrier rates may apply.
The Company is not responsible for carrier filtering, delivery delays, or consent disputes arising from User conduct. You agree to indemnify the Company for claims resulting from your messaging activity.
7. Fees & Payments
Certain features may require payment or credit usage. Fees are non-refundable unless required by law. The Company may modify pricing upon reasonable notice.
Failure to maintain required credits or payment may result in feature restrictions or suspension.
8. Data & Retention
The Company stores data to provide the Service but does not guarantee permanent retention, court admissibility, or evidentiary sufficiency. Users are responsible for maintaining their own backups.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.
Total liability shall not exceed the greater of $100 or the amount paid by the User in the preceding three (3) months.
11. Indemnification
You agree to defend, indemnify, and hold harmless ZanKo, LLC from claims arising from your use of the Service, including disputes with clients, SMS-related claims, or contract disputes.
This obligation survives termination.
12. Arbitration & Class Action Waiver
Any dispute shall be resolved through binding arbitration in Louisiana under AAA rules. Users waive the right to jury trial and class or representative actions.
13. Termination
The Company may suspend or terminate access for violation of these Terms or non-payment.
14. Governing Law
These Terms are governed by the laws of the State of Louisiana.
